Contradiction in the Duty to Report when Professional Secrecy exists

This article analyzes the normative contradiction between Articles 276 and 424 of the Ecuadorian Comprehensive Organic Criminal Code. The former stipulates that professional secrecy cannot be invoked to justify failure to report, while the latter stipulates that there is no obligation to report when knowledge of the facts is protected by professional secrecy. The former provides criminal penalties for failure to report due to a profession, position, or occupation, while the latter exempts criminal liability when professional secrecy exists. Therefore, the contradiction found is necessary and worthy of analysis in order to draw conclusions that allow us to determine whether or not criminal liability exists when a professional fails to report. The contradiction will be analyzed, following the model of the normative system of Alchourrón and Bulygin, in order to establish a solution to the proposed contradiction.
